Welcome to the website of American Plumbing Heating & Cooling (“American PHC,” “we,” “us,” or “our”), located at americanphc.com (the “Site”). We are a licensed Florida contractor (License #CAC1821761, #CFC1431919) providing plumbing, heating, and air conditioning services in Sarasota, Bradenton, Cape Coral, Lakewood Ranch, Venice, Milton, Navarre, and nearby Florida communities. By accessing or using the Site, you agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Site.

1. Acceptance & eligibility

These Terms are a binding agreement between you and American Plumbing Heating & Cooling. You must be at least 18 years old (or the age of majority where you live) to request service through the Site. By using the Site, you represent that you meet this requirement and that any information you submit is accurate and yours to provide.

2. Our services & this website

The Site describes our residential plumbing, heating, and air conditioning services and lets you request appointments, estimates, and information. The Site itself does not perform diagnostics or complete transactions for service work. Any actual service engagement is governed by the written estimate, invoice, or service agreement you receive from us, which states the scope, price, and warranty terms for that work. If those documents conflict with these Terms, the signed service documents control for the work they cover.

3. Estimates & quotes

Any prices, estimates, promotions, rebate amounts, or availability shown on or generated through the Site are for general guidance only, are not a binding offer, and may change without notice. Final pricing depends on an on-site evaluation of your system and property and is confirmed in a written estimate or service agreement before work begins. Promotions and rebates are subject to their own eligibility requirements, expiration dates, and — for utility or manufacturer rebates — the rules of the issuing organization, which we do not control.

4. No professional advice

Content on the Site — including guides, articles, FAQs, symptom checkers, and troubleshooting tips — is provided for general informational purposes only. It is not professional advice for your specific system, property, or situation, and it is not a substitute for an on-site diagnosis by a licensed technician. Never attempt repairs that require a license, and treat gas leaks, electrical hazards, and major water leaks as emergencies: leave the area if needed and call a professional or 911.

5. Intellectual property & limited license

The Site and its content — text, graphics, logos, images, and software — are owned by or licensed to American Plumbing Heating & Cooling and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. You may not copy, modify, distribute, scrape, republish, or create derivative works from the Site content without our prior written permission, except as permitted by law.

6. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Submit false, misleading, or fraudulent information (including fake service requests);
• Interfere with the Site's operation, security, or availability, or attempt to gain unauthorized access to any systems or data;
• Use automated means (bots, scrapers) to access the Site in a way that burdens our infrastructure or evades access controls;
• Impersonate any person or misrepresent your affiliation with anyone.

7. Your submissions

When you submit information through the Site (for example, a service request, review, or job application), you grant us the right to use it to respond to you and provide service, as described in our Privacy Policy. You are responsible for the accuracy of what you submit. Do not send us confidential or proprietary information through the Site beyond what we ask for.

8. Third-party services & links

The Site may link to or integrate third-party websites and services — for example, equipment manufacturers, review platforms, utility rebate programs, the Square checkout used for our maintenance plan, or a financing lender. Those third parties are not under our control, and we are not responsible for their content, terms, or privacy practices. Your use of any third-party service is at your own risk and subject to that party's terms.

9. Financing & payments

We do not collect or process payment-card information on the Site. If you enroll in our maintenance plan, checkout is completed on a Square-hosted payment page under Square's own terms and security practices. Financing, when available, is offered through third-party lenders: any application is made directly with the lender, the credit decision is the lender's alone, and your financing agreement is with the lender — American Plumbing Heating & Cooling is not a lender and does not make credit decisions. Terms and eligibility vary.

10. Warranties & disclaimer

Our work. We stand behind our workmanship — our work is guaranteed as stated in the written estimate, invoice, or service agreement for your job, which describes the specific warranty terms that apply. Manufacturer warranties on equipment and parts are provided by the manufacturer under the manufacturer's own terms and registration requirements.

The Site. The Site and its content are provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim all warranties regarding the Site itself, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. This paragraph concerns the Site only — it does not limit or disclaim any warranty we expressly provide in a signed service agreement, and it does not limit rights you may have under Florida consumer-protection law that cannot be waived.

11. Limitation of liability

To the fullest extent permitted by law, American Plumbing Heating & Cooling and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100). This section applies to the Site only and does not limit our responsibility for services performed under a signed service agreement, nor any liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless American Plumbing Heating & Cooling and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right in connection with the Site.

13. Governing law & dispute resolution

Governing law. These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

Informal resolution first. Before starting any court proceeding, you agree to contact us at [email protected] or (941) 735-6616 and give us 30 days to try to resolve the dispute informally. Most concerns can be resolved quickly this way.

Venue. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to the personal jurisdiction of those courts. Either party may instead bring a qualifying claim in small-claims court.

14. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or misused the Site. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) survive.

15. General terms

These Terms, together with our Privacy Policy, are the entire agreement between you and American Plumbing Heating & Cooling regarding the Site. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We may update these Terms from time to time — when we do, we will revise the “Last updated” date at the top of this page, and changes take effect when posted. Your continued use of the Site after an update means you accept the revised Terms.
